Commercial Court Lawyer Near Gurugram District Court

Business suit in Gurugram? The commercial court after the 2026 move to the Tower of Justice, mediation at DLSA Gurugram, papers to carry and next steps.

By Advocate B.K. SinghFinding a LawyerUpdated 1 November 202619 min read

In short. Any business suit of Rs 3 lakh or more from Gurugram, Manesar, Sohna or Pataudi lands in the same court. It's the one designated as Commercial Court for Gurugram district, and that's where a commercial court lawyer near Gurugram court spends the working day. A fire in May 2026 wrecked part of the old complex. Since July, the courts have sat in the new Tower of Justice. First comes mediation through DLSA Gurugram, which can take three to five months, and a fought suit often lasts eighteen months to three years after that. If your file was there before the fire, look at it now.

Is this your situation?

  • A client in Gurugram owes your business Rs 3 lakh or more. You've chased it for months and now want to sue.
  • Your commercial suit was pending at the old Gurugram court complex when the May 2026 fire happened, and nobody can tell you if your file survived.
  • You've got a hearing date in Gurugram but no idea which floor or courtroom your court moved to in the new building.
  • The contract you signed with a Cyber City or Golf Course Road company says only Gurugram courts will have jurisdiction.
  • A summons or mediation notice has reached your unit in Udyog Vihar, IMT Manesar or on Sohna Road.
  • You're in Delhi, near Dwarka, and the case looks like it could be filed in Delhi or in Gurugram. You can't tell which makes more sense.
  • A former distributor, partner or employee is hurting your business in Gurugram, and you need a court order quickly.

Which court hears commercial suits in Gurugram?

The court designated as the Commercial Court for Gurugram district. Haryana set up commercial courts in every district in 2016, at the level of District Judge, with the Punjab and Haryana High Court's concurrence. Any commercial suit worth Rs 3 lakh or more arising in Gurugram district goes there. Cyber City, Udyog Vihar, IMT Manesar, Sohna, Pataudi, Farrukhnagar. All of it. The sub-divisional civil courts don't take these suits.

Value has no upper limit here. The Punjab and Haryana High Court has no original civil side, so a Rs 5 lakh claim starts in the Gurugram commercial court, and so does a Rs 50 crore one. Judges get transferred. A busy district can also have more than one judge on commercial work. So the safe phrase is the court designated as Commercial Court for Gurugram on the day you file.

This guide sticks to the practical side. Where that court sits now, what changed after the 2026 fire, what to check if your case was already pending, and how to pick and work with a Gurgaon commercial court lawyer. Jurisdiction and procedure in full are on our page on the Gurugram commercial court.

The Tower of Justice: where the Gurugram courts are now

Fire broke out in the old Gurugram district court complex on 24 May 2026. According to reports, it started in the record room, gutted Court Halls 1, 2 and 3, and destroyed a large number of records. For several weeks after that, around twenty courts ran out of a PWD guest house in Civil Lines, mostly taking up urgent matters. Hundreds of lawyers had no chambers.

The move came fast. On 9 July 2026 the Punjab and Haryana High Court allowed the courts to shift forthwith into the new judicial complex, the Tower of Justice, though some clearances hadn't come through. Three days later, on 12 July 2026, the Chief Justice of India, Justice Surya Kant, inaugurated it. It sits on roughly seven acres. Two blocks, one of eight floors and one of seven, with parking underground and room planned for more than fifty courtrooms. Announcements at the time also mentioned a proposed international arbitration centre, a crèche and waiting areas for litigants.

Plenty is still unfinished. When the courts moved, reports spoke of interiors not yet done and permits still awaited. Land beside the complex for lawyers' chambers had only just been cleared by the High Court's building committee, with no date for construction. For a litigant that has two practical effects. Your lawyer may still be without a chamber in the building, and the first visit can go in hunting for the right floor and courtroom. Check the address, courtroom and floor on the Gurugram district court website before every date. Don't trust last month's notes.

If your case was pending before the fire, check these now

First, the court's own file, and whether it survived whole. Where records were lost, courts generally allow them to be rebuilt from certified copies plus whatever pleadings and documents the parties themselves hold. That's quick if your lawyer kept a complete indexed set of every filing. A few weeks. If nobody kept one, you're in for a slow hunt through the other side's papers, the copying section and old email threads.

Second, check the next date against your CNR number on eCourts services. Lots of matters were adjourned in bulk during the guest house weeks, and again after the move. A date may have been fixed while you weren't looking. And an order passed in your absence is much harder to undo than to prevent.

Third, look at the deadlines that kept running. The fire didn't pause any of them. Not the 120-day limit for a written statement in a commercial suit, not the 60-day appeal period, and not limitation for a new suit. If any of these fell during the disruption, get advice at once on whether you need an application explaining the delay. Our guide on what to do if your commercial case has been pending for years covers getting a stuck matter moving again.

What the Gurugram commercial court hears, and what goes elsewhere

Commercial disputes, as Section 2(1)(c) of the Commercial Courts Act, 2015 defines them, with a specified value of Rs 3 lakh or more under Section 2(1)(i). Gurugram's mix leans heavily towards technology and service contracts. After those come supply and component fights, leases of offices and warehouses used purely for business, terminated franchise and distribution deals, and trademark and copyright suits. Section 12 governs valuation. Interest up to the filing date goes into the figure.

It also takes the applications under the Arbitration and Conciliation Act, 1996 that the law sends to a commercial court. A Section 9 petition for interim relief, where the arbitration is about a commercial dispute, is the usual one. The arbitration itself, and challenges to awards, are covered on arbitrationlawyer.in.

Real estate drives a huge share of Gurugram litigation, and much of it never reaches the commercial court. Homebuyers fighting a builder go to Haryana RERA at Gurugram or to a consumer commission. A bank chasing Rs 20 lakh or more goes to the Debts Recovery Tribunal. Insolvency against a company that's defaulted on Rs 1 crore or more is an NCLT matter. If you can't place your claim, our page on which court will hear your case takes you through the value and territory rules.

Choosing a commercial court lawyer near Gurugram court

Don't pick on address. Pick on attendance and follow-through. The Gurugram district bar is Haryana's largest, with more than eleven thousand registered advocates, so there's no shortage of lawyers near the court. What you need is the one who'll be in the right courtroom when your matter is called, inspect the file when something looks off, and tell you the same day what happened.

The months since the move make that matter more. Courtrooms have been reshuffled, chambers aren't built, and some records are still being rebuilt. A lawyer who checks the file and the cause list every single time will catch problems others miss. At the first meeting, ask who'll attend routine dates, who'll go to mediation at the District Legal Services Authority, and how you'll be kept posted.

Then look hard at the drafting. Your opponent in Gurugram is often a big company with its own legal department. Set out the contract, what you did, how it was accepted and what's due, in a clean timeline, with every document disclosed under Order XI, and you start level with them on the first date. Our guide on ten checks before hiring a commercial court lawyer applies in Gurugram just as much.

Working from Dwarka: how we take up Gurugram matters

We have two offices, Dwarka in New Delhi and Vaishali in Ghaziabad, and Advocate B.K. Singh and Advocate Sadhna Singh appear in courts across Delhi NCR from both. Gurugram work runs out of Dwarka. It's a short drive down the Dwarka Expressway or the old Gurgaon road, far shorter than crossing Delhi. Some matters need someone in Gurugram every day, more than we can give. For those the firm brings in associate counsel there, and you'll know that from day one.

Advocate Sadhna Singh handles recovery and commercial court files day to day, working with Advocate B.K. Singh, who reads the papers first and decides the route. On a Gurugram file he reads the jurisdiction and arbitration clauses before he even looks at the invoices. Contracts with big Gurugram companies very often lock disputes into one city or push them to arbitration.

We talk about fees at the first meeting and agree them in writing, one stage at a time. Haryana court fee, the mediation fee and process costs come on top. Getting to Dwarka isn't always easy. That's fine. We can read your papers online first, the way our guide on how clients outside Delhi work with the firm describes.

Bringing a commercial suit in Gurugram, step by step

This is the usual route for a business owed money in Gurugram. Urgent injunction cases skip mediation. More on that further down.

  1. Check limitation and read the contract

Most money claims have to be filed within three years under the Limitation Act, 1963. Read the jurisdiction clause, the arbitration clause and any notice clause the same day. Don't leave it.

  2. Pick the forum

Section 20 of the Code of Civil Procedure lets you sue where the defendant carries on business or where the cause of action arose. If both Delhi and Gurugram are open, choose on purpose, not by habit.

  3. Send a legal notice

A clear notice sets out the dues, interest and a deadline. Big companies often pass it to their legal team, and that sometimes produces a structured settlement offer.

  4. Apply to DLSA Gurugram for mediation

Section 12A mediation runs up to three months, and two more with consent. If the other side doesn't join, a non-starter report issues. Then you file.

  5. File the plaint

It goes in with a statement of truth, all documents, a list of documents and the Order XI declaration. Court fee is ad valorem, on the Haryana schedule.

  6. Serve, then track the defence

The defendant gets 30 days for a written statement, stretchable with costs to 120. In a summary suit it must appear within 10 days and ask for leave to defend.

  7. Case management, evidence, judgment

After admission and denial of documents, the court sets a timetable under Order XVA. Evidence is by affidavit, with cross-examination. Then arguments, then judgment.

Where the claim rests on a written contract, an acknowledged invoice or a cheque, think about a summary suit. There the defendant can't defend at all unless the court grants leave.

Mediating with big companies at DLSA Gurugram

Pre-institution mediation for a Gurugram case is handled by the District Legal Services Authority, Gurugram. The rules are the Commercial Courts (Pre-Institution Mediation and Settlement) Rules, 2018. You file a short application, and the Authority puts the other side on notice. Two things work in your favour. Any settlement signed before the mediator has the status of an arbitral award, and the mediation months don't count towards limitation.

Mediation tends to work better in Gurugram than people expect. There's a reason. A large company often can't pay a disputed vendor without a formal record that will satisfy its auditors and its internal approvals, and a signed mediation settlement gives it exactly that. If the company sends a representative, find out early whether that person can sign, or how long internal approval will take. Then fix the next session around that.

If the company ignores the notice, don't hang about. Take the non-starter report and file. Our guide on how startups can recover dues from large clients looks at what it's like suing a much bigger company, and the rules are on our legal services authority mediation page.

Papers to bring for a Gurugram commercial matter

  • The master services agreement, statement of work, purchase orders and any amendments
  • Acceptance emails, sign-offs, timesheets or completion certificates, if you supplied services
  • Invoices, and the GST returns showing them
  • Your ledger for the client, and bank statements showing part payments
  • Debit notes, credit notes, and any reconciliation statement you swapped with the buyer
  • The termination notice, or any letter where they disputed your performance
  • The defendant's MCA master data and the addresses on its GST registration
  • A board resolution or authority letter for whoever signs the plaint
  • Any summons, mediation notice or order you've already received, with the dates
  • Section 63 certificate under the Bharatiya Sakshya Adhiniyam for emails, portal records and chats

Gurugram or Delhi, when you could file in either

Plenty of Gurugram disputes have two possible homes. Take a company registered in Delhi that actually operates out of Gurugram. It can usually be sued in either city. Or a Delhi supplier delivering to a plant in Manesar, which may have part of its cause of action in each. Where you really can choose, write the factors down side by side. Habit is a poor reason.

The two systems really do differ. Gurugram gives you one commercial court track, no upper limit, Haryana's court fee schedule and appeals that go to Chandigarh. Delhi divides suits by value, up to Rs 2 crore in the district commercial court and above that in the Commercial Division of the Delhi High Court, with Delhi's own court fee schedule and appeals heard in Delhi. There's a wrinkle. In July 2026 the Delhi High Court recommended that the district limit go up to Rs 10 crore, which would need a legislative amendment, so check where the limit stands when you file.

Think about execution, too. If you get a Gurugram decree against a company whose bank accounts are in Delhi, it'll have to be sent to a Delhi court to execute. The Delhi side of all this is in our guide on which court hears a commercial dispute above Rs 2 crore in Delhi.

What Gurugram businesses actually fight about

Around Cyber City, Golf Course Road and Sohna Road, the tech and service companies mostly fight over what was in scope and whether it was ever accepted. Termination for convenience is the other big one. The client insists it never accepted the work. The vendor says the client's been using it for months. Sign-off emails, change requests and usage logs decide these cases, so save them now, before your access to the client's systems gets switched off.

In IMT Manesar and Udyog Vihar, auto component makers and their sub-vendors work on schedule agreements where rejections, debit notes and price revisions pile up month after month. The fight is usually about reconciliation. Not liability. A clean, item-wise reconciliation is the strongest paper a supplier can walk in with. Garment exporters in Udyog Vihar often deal with buyers abroad, and that raises jurisdiction questions of a different kind.

Then there are the lease and licence fights, brought by warehouse operators on NH-48 and the KMP Expressway, by landlords of office floors, and by co-working operators. Property leased purely for business makes it a commercial dispute. Franchisors are a different animal. If a franchisee you've terminated is still trading under your brand, you need an injunction far more than money. Urgency goes up, and the route changes.

Practical points for the Gurugram court in late 2026

  • Keep your own complete set. Since the fire, the side holding a full indexed copy of every filing is the side whose case keeps moving. Ask your lawyer for a soft copy of everything that's been filed.
  • Get there early the first time. The building's new, courtrooms have been reshuffled, and the signs may not have caught up. Give yourself time to find the right floor.
  • Serve at every address you know. Lots of Gurugram defendants have registered offices in Delhi or further away. Use the MCA master data, the GST principal place of business and email addresses that actually work.
  • Expect English and Hindi. Pleadings are mostly in English. Some orders and records may be in Hindi, and translations help if the matter goes up to Chandigarh.
  • Expect a forum fight early. Big defendants often open with an application to return the plaint or to send the dispute to arbitration. Have your answer on territory and the contract clause ready before the first date.

An invented example: a Dwarka IT reseller and a Gurugram co-working operator

This is invented. An IT hardware reseller with an office in Dwarka supplies laptops, firewalls and networking gear worth Rs 46 lakh to a co-working operator for three centres in Gurugram. The operator pays Rs 12 lakh and installs everything. Then it stops paying, pointing to two faulty firewalls. Its purchase orders say disputes go only to the courts at Gurugram.

The reseller would rather have sued in Delhi, where its office and witnesses are. But delivery and installation happened in Gurugram, so the Gurugram court clearly has jurisdiction, and the clause in the signed purchase orders will probably be enforced. The reseller applies to DLSA Gurugram. The operator turns up, admits most of the dues, and offers Rs 20 lakh in four instalments if the firewalls are replaced.

The reseller agrees to replace them and settles at Rs 30 lakh in three instalments. There's a clause making the whole balance payable on any default. Since the settlement has the status of an arbitral award, a missed instalment can be enforced without a suit. None of this is real. Actual disputes can end quite differently.

Urgent orders, appeals and execution in Gurugram

Some harm can't wait for a full trial. The commercial court in Gurugram has the tools for that: a temporary injunction under Order XXXIX of the Code of Civil Procedure, attachment before judgment under Order XXXVIII Rule 5, a receiver under Order XL. You can skip Section 12A mediation if the suit genuinely needs urgent interim relief. Be careful with that. The Supreme Court in Yamini Manohar v. T.K.D. Keerthi (2023) held that the urgency must be visible on the plaint and the documents themselves. In urgent matters that come to Advocate B.K. Singh, what usually tips it is dated proof of what the other side is doing this week. Our page on urgent injunctions has more.

Lose at trial and the appeal lies to the Commercial Appellate Division of the Punjab and Haryana High Court at Chandigarh. Section 13 gives you 60 days. Execution carries on regardless unless the High Court stays it, and a stay frequently comes on condition of a deposit. No stay means the decree holder can file execution under Order XXI right there in Gurugram, or have the decree transferred to wherever the assets are. The appeal stage is explained on our Punjab and Haryana High Court page.

Mistakes Gurugram businesses make in commercial cases

  • No copy of the court file. The 2026 fire showed just how much rides on the parties' own records.
  • Ignoring the arbitration clause. Plenty of Gurugram contracts have one. Sue in the face of it and you'll get an application under Section 8 of the Arbitration Act, and months of delay.
  • Letting internal approvals swallow the 120 days. Large defendants lose the right to file a written statement because legal, finance and the business team each take a month over it.
  • Sitting on an injunction. Delay is itself a reason courts refuse urgent relief. Move the moment you find out your brand or data is being misused.
  • Assuming Delhi is always the better bet. If the contract and the facts point to Gurugram, filing in Delhi can get the plaint returned.

What to do this week for a Gurugram dispute

A hearing date coming up is often what sends people looking for a commercial court lawyer near Gurugram court. Start with the record. For a case that was already pending when the fire hit, look up the next date on eCourts, ask your lawyer straight out whether the court file is whole, and get your own full copy of everything filed. A new claim needs different things this week. Your limitation date. A careful read of the jurisdiction and arbitration clauses. And the documents from the checklist above, sorted by date. Our page for a commercial court lawyer in Gurugram goes deeper into local practice.

Gurugram files are taken up by Advocate B.K. Singh and Advocate Sadhna Singh, working from Dwarka and Vaishali. Ring or WhatsApp +91 96259 61599. You can also send the contract, invoices and any court papers to Advocate B.K. Singh's team through the contact page. We'll come back with advice on the next step.

Frequently asked questions

Where are the Gurugram district courts now?

The Tower of Justice. That's the new judicial complex, inaugurated on 12 July 2026 after the May fire damaged the old one, and the courts have sat there since July 2026. Before each date, check your courtroom and floor on the district court website.

Were court records lost in the Gurugram court fire?

Reports said a large number of records in the record room were destroyed. If a file is incomplete, courts generally let it be rebuilt from certified copies and the parties' own sets of pleadings and documents.

Is there an upper limit for commercial suits in Gurugram?

No. Any commercial suit of Rs 3 lakh or more from the district goes to the Gurugram commercial court, however big. The Punjab and Haryana High Court has no original civil side.

Can a suit from Manesar or Sohna be filed in the local court there?

No. Commercial suits of Rs 3 lakh and above from anywhere in Gurugram district go to the designated commercial court at the district headquarters. The sub-divisional civil courts don't take them.

Who handles Section 12A mediation in Gurugram?

The District Legal Services Authority, Gurugram. It sends notice to the other side and holds sessions if both sides join. If the other side doesn't respond, it issues a non-starter report.

Can I sue a Gurugram company in Delhi instead?

Only if the company carries on business in Delhi or part of the cause of action arose there, and no binding clause ties disputes to Gurugram. Before deciding, weigh court fee, the appeal court and where the company's assets are.

Where do appeals from the Gurugram commercial court go?

To the Commercial Appellate Division of the Punjab and Haryana High Court at Chandigarh, within 60 days under Section 13 of the Commercial Courts Act. Interim orders can be appealed only if they're listed in Order XLIII CPC.

Does the firm have an office in Gurugram?

No. Our offices are in Dwarka, New Delhi and Vaishali, Ghaziabad. Gurugram matters are run from Dwarka, with associate counsel in Gurugram where someone has to be there daily.
