Commercial Court Lawyer Near Vaishali, Ghaziabad: Where Your Case Will Be Heard

From Vaishali, a commercial suit may go to Ghaziabad, Karkardooma, Surajpur or the Delhi High Court. How jurisdiction, value and costs decide the court.

By Advocate B.K. SinghFinding a LawyerUpdated 1 November 202621 min read

In short. If you run a business from Vaishali and someone owes you money, the first thing a commercial court lawyer near Vaishali, Ghaziabad has to settle is which court hears it. You're right on the Delhi border. So four courts are realistic. The court designated as Commercial Court for Ghaziabad district. The Karkardooma commercial courts in East Delhi. The Gautam Buddh Nagar court at Surajpur. And, for Delhi claims above Rs 2 crore, the Delhi High Court. Where the other side does business, where the deal was made or carried out, and the claim value decide it. It takes a day or two with the papers. Bring the contract and invoices.

Is this your situation?

  • You run the business out of Kaushambi or Sahibabad, the customer's dues crossed Rs 3 lakh months ago, and now the calls go unanswered.
  • The buyer sits just across the border, in Laxmi Nagar or a Noida sector or somewhere else in Ghaziabad, and nobody has told you straight which court to go to.
  • You dug out the contract. It says nothing about jurisdiction. Or worse, it names a court in a city where none of the work happened.
  • A summons arrived from Karkardooma (or Surajpur, or Ghaziabad) over a deal you'd always thought of as a Vaishali deal, and you're wondering if that court can hear it at all.
  • With interest added, your claim has gone past Rs 2 crore, and someone at the office said it has to be the Delhi High Court now.
  • You'd like one lawyer near Vaishali, Indirapuram side, who'll actually turn up in courts on both sides of the Delhi and UP border.

Which court will hear your Vaishali case? The short version

Not the one nearest your house. The court is decided by where the other side does business and where the deal took place. Vaishali is in Ghaziabad district, in UP, but Anand Vihar in Delhi is a few minutes away and Noida isn't far either. Most businesses here trade in all three places. Their disputes end up in all three too.

In practice it comes down to four courts. Is the defendant in Ghaziabad district, or was the deal made or carried out there? In that case it's the court designated as Commercial Court for Ghaziabad district. If the defendant is in East, North East or Shahdara district of Delhi, or the cause of action arose there, the case goes to the commercial courts at Karkardooma, so long as the claim isn't above Rs 2 crore. Cross that figure and a Delhi case goes to the Commercial Division of the Delhi High Court. And if the defendant or the deal is in Noida or Greater Noida, you're looking at the Gautam Buddh Nagar court at Surajpur.

Quite often two of these are open. That's fine. It's a choice, and we'd rather you make it on purpose than by accident. Any commercial court lawyer near Vaishali, Ghaziabad should spend the first meeting on this before talking about anything else. The rest of this guide shows how we do it.

Three things a court checks before it'll hear you

One. Is it a commercial dispute at all, as Section 2(1)(c) of the Commercial Courts Act, 2015 defines it? The list is long. Ordinary dealings between businesses, supply and distribution, construction and infrastructure contracts, service agreements, partnership and shareholder agreements, franchising, intellectual property, insurance, and leases of property used only for business all fall in, among others. A dealer supplying medical consumables to a hospital in Vaishali? Commercial. Two neighbours in a Vaishali housing society lending each other money usually isn't.

Two. The specified value has to be Rs 3 lakh or more, worked out under Section 12 of the Act. On a money claim, you add interest up to the day you file. Below Rs 3 lakh, even a purely business claim goes to the ordinary civil court.

Three. The court needs territorial jurisdiction under Section 20 of the Code of Civil Procedure, 1908 (CPC). You can sue where the defendant lives or carries on business, or where the cause of action arose, wholly or partly. For a company, the Explanation to Section 20 says it carries on business at its principal office, and also at a branch office if the cause of action arose at that branch. Clients find the next bit annoying. Your own address, on its own, doesn't give any court jurisdiction.

When the case stays in UP: the Ghaziabad commercial court

The Ghaziabad district courts are next to the Collectorate at Raj Nagar, on the other side of the Hindon from Vaishali, and they've been there since the move from the old campus at Model Town, Gandhinagar. The District Legal Services Authority (DLSA), Ghaziabad, which runs Section 12A mediation for the district, works from the same premises.

Every Ghaziabad commercial filing should begin with one local quirk. When Uttar Pradesh first set up commercial courts by government orders in late 2017, it did so in thirteen districts, and it gave the Gautam Buddh Nagar court jurisdiction over Ghaziabad and Hapur as well. Things have changed since. Designations and postings get revised, and the Allahabad High Court issues notifications as courts are created and officers posted. So before you file, check the current notification and the eCourts listing. You want to know which court is taking Ghaziabad commercial matters that month. Get it wrong and you lose months.

Two more things about UP practice matter to a Vaishali business. There's no upper value limit at district level. The Allahabad High Court doesn't try civil suits on an original side, so a Rs 12 crore dispute goes to the district-level commercial court exactly like a Rs 8 lakh one would. And court fee is paid under the Court Fees Act, 1870 as amended for Uttar Pradesh. That schedule isn't Delhi's. Check the current figure. For filing, listing and appeals, see our page on the Ghaziabad commercial court. The court complex itself is covered in our guide for a commercial court lawyer near Ghaziabad District Court.

Karkardooma: the Delhi court next door

Ask most Vaishali traders and they'll tell you Karkardooma is quicker to reach than the Ghaziabad courts. The complex in East Delhi houses the courts for the East, North East and Shahdara districts. That includes District Judge (Commercial Court) benches hearing commercial suits from Rs 3 lakh up to Rs 2 crore. That ceiling may move. In July 2026 the Delhi High Court's Full Court recommended raising it to Rs 10 crore, which needs an amendment to the law. Check the current limit before you file.

Karkardooma is the right court when your buyer, distributor or contractor does business in places like Laxmi Nagar, Preet Vihar, Mayur Vihar, Patparganj, Shahdara or Gandhi Nagar. Same if the goods were delivered there, or the work was done there. It happens all the time. Plenty of Vaishali traders supply the East Delhi wholesale markets, and plenty of Vaishali service firms work for offices and hospitals on that side.

Filing in East Delhi is covered step by step in our guide for a commercial court lawyer near Karkardooma Court.

Surajpur and the Delhi High Court: the other two

The Gautam Buddh Nagar district courts are at Surajpur in Greater Noida. Sell to a Noida factory, service an office in a Noida sector, or do fit-out work in a Greater Noida building, and you may have to sue there. You may get sued there too. It works much like Ghaziabad, in that there's no upper value limit at district level and any appeal goes to the Allahabad High Court. That complex is covered in our guide for a commercial court lawyer near Surajpur Court.

The Delhi High Court only comes in for Delhi cases above Rs 2 crore. Say a Vaishali developer has a Rs 3.5 crore claim against a company whose principal office is in Connaught Place, or the contract was signed in Delhi and payable there. That suit goes to the Commercial Division on the High Court's original side, at Sher Shah Road. You'll face the High Court's own e-filing system, tougher scrutiny at filing, and more riding on costs. How those suits run is explained in our guide for a commercial lawyer near the Delhi High Court.

Some disputes spread wider still. A Vaishali firm chasing a Gurugram buyer, for example. Our guide on where to file a commercial suit in Noida, Ghaziabad and Gurugram puts the three NCR districts side by side.

Delhi or Ghaziabad? How we'd choose

When a Delhi court and a UP court both have jurisdiction, it usually comes down to five practical things. Court fee is the first. Delhi and Uttar Pradesh have different schedules, and on a big claim the gap can be serious. Run the numbers on current figures before you decide.

Then the appeal route. Appeals from Karkardooma or the Delhi High Court stay in Delhi. An appeal from a Ghaziabad or Surajpur commercial court goes to the Commercial Appellate Division of the Allahabad High Court, whose principal seat at Prayagraj covers western UP. Video hearings are widely allowed there. That's a help. Still, some clients just want an appeal court they can drive to in an hour, and we understand why.

Third, where are the defendant's assets? A decree can be sent elsewhere for execution under Section 39 CPC, but life's simpler when it's passed where the bank accounts and property already are. Fourth, your witnesses and records. If your accountant and site engineer both work in Sahibabad, a Ghaziabad court saves them days off work. Fifth, language and habit. UP district courts often write orders in Hindi, while Delhi courts mostly work in English. Neither is a problem. Just know it going in.

None of this lets you forum shop on thin facts. Whichever court you pick, the plaint must plead the facts that give it jurisdiction. Plainly. A defendant who spots a weak territory paragraph will apply for return of the plaint under Order VII Rule 10 CPC. Frankly, a suit sent back after a year to be refiled somewhere else is the most avoidable delay we see in commercial cases.

Getting to these courts from Vaishali

Vaishali metro station is the end of the Blue Line branch that runs through Kaushambi, Anand Vihar and Karkarduma into central Delhi. For the Karkardooma courts, take the Blue Line to Anand Vihar or Karkarduma and switch to the Pink Line for Karkarduma Court station. It's right beside the complex. By road it's a short hop across the border. Mornings at Anand Vihar can be bad, though.

Most people drive across the Hindon to the Ghaziabad courts at Raj Nagar. Some use the Red Line's Ghaziabad stations or the Namo Bharat corridor and take an auto or cab from there. You'll want extra time on the first visit. Finding the right courtroom, and then the DLSA office, in a crowded district complex takes longer than you'd think.

Surajpur means driving through Noida towards Greater Noida. On most days it's the longest of the four trips. For the Delhi High Court, the Blue Line carries you towards central Delhi. Whichever court it is, check the cause list for the courtroom and item number the night before. Check again in the morning.

Section 12A mediation: which authority do you go to?

You can't file a commercial suit until you've applied for pre-institution mediation under Section 12A of the Commercial Courts Act. The only exception is a genuine need for urgent interim relief. The Supreme Court made this mandatory for suits filed from 20 August 2022, in Patil Automation v. Rakheja Engineers (2022). Skip it and the plaint gets rejected under Order VII Rule 11 CPC.

Mediation is run by the legal services authority linked to the court where you plan to file. A Ghaziabad suit means the DLSA, Ghaziabad. A Karkardooma suit means the DLSA for the Delhi district concerned, whose mediation centre usually sits inside the Karkardooma complex. For a Delhi High Court suit, it's the authority designated for High Court matters. So pick the court first, then the authority. Otherwise you can end up attaching one forum's mediation report to a suit filed in another, and the defendant may well make an issue of it.

It'll take up to three months, and can run two more if both sides agree. That time doesn't count towards limitation. A settlement signed before the mediator has the status of an arbitral award. If the other side ignores the notice, you get a non-starter report. Then you file.

How we work out where to file

We take a jurisdiction question in this order, before anyone spends a rupee on court fee.

  1. Note every fact that touches a place

Where was the order placed and accepted? Where did the goods go or the work get done, where was payment due, and into which bank account did it go, since the bank trail is often the cleanest proof of the lot? Where's the registered office? And where does the defendant really work from? Any answer might point to a court.

  2. Work out the value

Add up principal and interest to the date you expect to file. Is it Rs 3 lakh or more? Would a Delhi suit cross Rs 2 crore?

  3. Read the clauses

Look for an exclusive jurisdiction clause, an arbitration clause, and any notice clause. A valid arbitration clause can take the whole dispute out of court if the defendant asks in time under Section 8 of the Arbitration and Conciliation Act, 1996. Don't skim this one.

  4. List the courts that can hear it

It's usually one to three. Cross off any where your link to the place is thin, or where it hangs on a fact the other side will dispute.

  5. Weigh up the practical side

Court fee. The appeal forum. Where the defendant's assets are, where your witnesses are, and how often you can realistically attend. Write the decision down so everyone knows why it was made.

  6. Apply to the right authority for mediation

File the Section 12A application with the legal services authority for the court you've chosen, unless there's a real need for urgent relief, which is the only good reason to skip it.

  7. Draft the jurisdiction paragraph carefully

Set out the facts that give the chosen court jurisdiction, with the documents that prove them. Then file the suit with the mediation report, the statement of truth and full disclosure under Order XI.

Disputes we often see from Vaishali and the Trans-Hindon side

Vaishali, Kaushambi and Indirapuram are a business district in their own right now. The towers near the Kaushambi and Vaishali metro stations are full of IT and BPO firms, chartered accountants, logistics companies and marketing agencies. The big hospitals in Vaishali buy equipment, consumables, housekeeping and software on contract. Builders and contractors in Indirapuram, Vaishali and Raj Nagar Extension take on dozens of vendors each. Then there's Sahibabad's industrial area next door, with its manufacturers and traders.

The fights follow the money. Service firms chase unpaid retainers and project fees, often under a master services agreement that was only ever signed over email. Medical equipment dealers chase hospitals for installation and maintenance dues. Contractors chase builders for running bills and retention money. In the sector markets and malls, landlords and shop tenants argue over rent, lock-in periods and security deposits. At Rs 3 lakh or more, any of these can be a commercial dispute.

What's different here is how often the other party is across the border. A Vaishali firm might do the job in Patparganj, raise the bill from Vaishali and get paid out of a Noida bank account. That's why we take up jurisdiction before the merits. It's also why a commercial court lawyer near Vaishali, Ghaziabad has to be at home in Delhi and UP courts alike.

Sued in a court far from your business?

It works the other way too. A Noida supplier might sue you at Surajpur, or a Delhi customer at Karkardooma, over what you'd always treated as a Vaishali deal. Don't ignore the summons because you think the court lacks jurisdiction. You still have to file the written statement within 30 days, which can stretch to 120 days and no further. Raise the jurisdiction objection in it. Where it makes sense, also move a separate application for return of the plaint under Order VII Rule 10 CPC.

Sometimes the court is legally right but hard for you to defend in. Transfer is possible, in limited cases. Inside one state, the High Court or district court can move a suit under Section 24 CPC. Between states, say from Delhi to Ghaziabad, only the Supreme Court can transfer, under Section 25 CPC. It does so sparingly. Most of the time your effort is better spent on a strong defence where the case already is.

Check two more things early. Did the plaintiff actually go through Section 12A mediation? Is there an arbitration clause? Either can decide the matter at the very first stage.

Mistakes that land Vaishali cases in the wrong court

  • Filing at home because it's easier. Your own office address doesn't give the Ghaziabad court jurisdiction. Some part of the cause of action, or the defendant's business, has to be there.
  • Taking it for granted that the Ghaziabad court hears Ghaziabad's commercial cases. Look at the current notification first. The old tie-up with Gautam Buddh Nagar has tripped up a lot of people.
  • Trimming a big Delhi claim to keep it at Karkardooma. Order II Rule 2 CPC can stop you suing later for the part you dropped.
  • Going to the wrong authority for mediation. Choose the court, then apply to the legal services authority attached to it. In that order.
  • Forgetting the arbitration clause. If there is one and the defendant applies in time, the suit gets referred to arbitration, and the court fee you paid may be wasted.
  • Leaning on a jurisdiction clause they never signed. One line printed on the back of your invoice is weak proof of an agreed court. Judges want to see that there's been real agreement.

An invented example: one Vaishali HVAC contractor, three possible courts

This one is made up. An air-conditioning and ventilation contractor runs its office from Vaishali Sector 4. It installs a central system in a new office building in Patparganj, East Delhi, for a company with its registered office in Noida Sector 62. The work order came by email from Noida and was accepted at the Vaishali office. After handover, Rs 64 lakh of the contract price and retention is still unpaid. The company now says the system is noisy. Then it stops replying.

Three courts are in play. Karkardooma, because the work was done in Patparganj, which is in the East district. Surajpur, because the registered office is in Noida. Ghaziabad is the weak one. Its only link is that the work order was accepted in Vaishali, and the defendant will argue an email acceptance happens where it's received. The contractor's site engineer and the building manager's records are in East Delhi. The defendant also banks at a Patparganj branch.

The contractor picks Karkardooma. It applies to the legal services authority there for mediation and gets a non-starter report when the company doesn't respond. The suit pleads the place of work and attaches the completion certificate signed at the Patparganj site, along with the defendant's own emails confirming handover. The claim is under Rs 2 crore, so it stays in the district court. Every name, figure and choice in this example is invented for illustration.

Commercial court lawyer near Vaishali, Ghaziabad: who comes to court from the Vaishali office?

Advocate B.K. Singh and Advocate Sadhna Singh appear in Delhi NCR courts from the firm's offices in Vaishali, Ghaziabad and Dwarka, New Delhi. From Vaishali, Karkardooma and the Ghaziabad courts are close. Surajpur and the Delhi High Court are within reach. So the same team can follow your dispute to whichever court is right for it. Advocate Sadhna Singh works on recovery and commercial court files day to day, alongside Advocate B.K. Singh. Why does a lawyer near Vaishali help? The courts that matter to you sit on both sides of the border, and somebody has to get to all of them.

Ask Advocate B.K. Singh which court a Vaishali case belongs in and he'll open the bank statements before the contract. Where the money was meant to be paid, and where it actually came from, often settles the place of the cause of action faster than any clause. Next he looks at where the defendant's assets sit. A decree from the right court is easier to execute. Our page on commercial court work in Ghaziabad describes what the firm does across the district. To set up a first meeting, see the guide on booking a consultation in Dwarka or Vaishali.

What to do this week

Take one sheet of paper and answer the four place questions. Where was the deal accepted? Where was it carried out? Where was payment due, and where does the other side really work? Under that, write the total due with interest up to today. Then find the date of the last payment or written acknowledgment. Limitation for most money claims is three years, and a written acknowledgment or part payment restarts it.

If any court has served you, write down the date of service and keep the envelope or the email. If the other side is moving assets, tell your lawyer straight away. That can justify an urgent application without waiting for mediation. We discuss fees at the first meeting and agree them in writing, stage by stage. Court fee and mediation fee are separate. For the Ghaziabad end of things, read our Ghaziabad commercial court page next.

Frequently asked questions

Is Vaishali under Delhi or Ghaziabad for court cases?

Vaishali is in Ghaziabad district, UP, so purely local cases go to the Ghaziabad courts. But if the other party is in Delhi, or the dispute arose in Delhi, you can file in a Delhi court. Your own address doesn't decide it.

Is there a separate commercial court in Ghaziabad?

Commercial suits go to whichever court is designated as Commercial Court for Ghaziabad district. When UP set up commercial courts in 2017, Ghaziabad was tagged to the Gautam Buddh Nagar court. That's been revised since. Check the current notification before you file.

Is there a value limit for commercial suits in Ghaziabad?

Not at the top. No upper limit applies at district level in UP, since the Allahabad High Court doesn't try suits on an original side. The floor is Rs 3 lakh, and anything below it goes to the ordinary civil court.

How do I get to Karkardooma court from Vaishali by metro?

Blue Line from Vaishali to Anand Vihar or Karkarduma, then the Pink Line to Karkarduma Court station. The station's right next to the complex. Outside rush hour it's a quick trip. Check the cause list for your courtroom before you set off.

Can I file in Ghaziabad if the buyer is in Delhi?

Only if part of the cause of action arose in Ghaziabad district. Say the goods were delivered there, payment was due there, or the buyer has a branch there tied to the deal. Your office being in Vaishali isn't enough. Plead the facts clearly, or the plaint may come back to you.

Where do appeals from a Ghaziabad commercial court go?

To the Commercial Appellate Division of the Allahabad High Court, within 60 days, under Section 13 of the Commercial Courts Act. Ghaziabad comes under the principal seat at Prayagraj. Video hearings are widely available.

Which is cheaper, filing in Delhi or in Ghaziabad?

It depends on the claim value. Delhi and UP each have their own ad valorem court fee schedule, so work out the figure under both current schedules before you choose. And don't decide on court fee alone. The appeal forum matters, and so does where the assets are.

Can a case filed against me in Noida be moved to Ghaziabad?

Within UP you can ask the High Court or district court for a transfer under Section 24 CPC. Courts want a good reason, though. If Noida does have jurisdiction, you'd normally defend there. If it doesn't, object in your written statement and apply for return of the plaint.
